Personal injury

## Product liability and defective products lawyer in Silverdale

Everyday products can hide defects that put the people using them in danger. If a product you trusted caused a serious injury, we help you understand what went wrong and what your options are.

Personal injury

## When a product fails the people who use it

Dangerous and defective products cause serious injuries and deaths every year. Too often, a manufacturer puts cost ahead of safety, cuts a corner in production or fails to tell people about a risk it knew about.

People who make and sell products have a responsibility to make them reasonably safe for their intended use and to warn about dangers that are not obvious. When they fall short and someone is hurt, the companies involved can be held responsible.

Kitsap Law Group represents people in Silverdale, Bremerton and across Kitsap, Jefferson and Mason Counties who were injured by defective products. We are not hesitant to take on large manufacturers and their insurers.

## Three ways a product can be defective

**Design defects.** A product has to do its job without putting the user at unreasonable risk. If the design ignores user safety or is flawed in a way that makes the product dangerous, every unit built to that design can be defective.

**Manufacturing defects.** Sometimes the design is sound, but corners are cut during production. The design was not followed, or poor materials were used, and the product that reached you was weaker or more dangerous than it should have been.

**Warning and marketing defects.** Some products carry risks even when they are designed and made correctly. In those cases, the company has a responsibility to warn users clearly about the risks. Product labels, user manuals and warnings on dangerous parts exist for this reason. When a company fails to warn properly, the product can be considered defective.

If you or a loved one was injured by a dangerous or defective product, contact Kitsap Law Group. Our attorneys can help you understand your options and pursue a claim for your losses.

5. 5Pursue the claimWe present the claim to the companies and their insurers and are prepared to go to court when needed.

Questions

## Frequently asked questions

### What should I do with the product that hurt me?

Keep it, and keep it as it is. Do not try to fix it or send it back to the manufacturer. Hold on to the packaging, instructions and receipt, and take photos. The product is often the most important evidence in the case.

### What are the main types of product defects?

Generally there are three: a design defect, where the product is unsafe as designed; a manufacturing defect, where a particular product was made wrong; and a warning defect, where the risks were not properly disclosed to users.

### Who can be responsible for a defective product?

Depending on the facts, the designer, the manufacturer, a parts supplier and the seller may all be involved. We look at the whole chain of companies that brought the product to you.

### What if I was using the product a little differently than intended?

That does not automatically end a claim. The question is often whether the use was reasonably foreseeable. An attorney can explain how the facts of your case may be viewed.

### What if the product has been recalled?

A recall can be helpful information, but it is not required for a claim, and a recall alone does not decide one. Let us know about any recall notices you have received.

### How long do I have to bring a product liability claim?

Washington sets time limits for product claims, and they can depend on when the injury happened and when it was discovered. An attorney can confirm the deadline for your situation.

### Is the consultation free?

Yes. There is no charge to meet with us about an injury from a defective product and learn your options.
